Under Title 25, California Code of Regulations, Section 5013, every Dealer is required to maintain an established place of business. The office must be a permanent structure and may not be temporary, transitory, or mobile in nature. The office must also comply with all applicable construction standards and local zoning requirements.
A manufactured home, mobilehome, or commercial modular may be used as the dealership office provided it is not part of the dealer's inventory, is not being offered for sale while serving as the office, and otherwise complies with all applicable laws.
In addition, California Health and Safety Code Section 18045.5 requires:
- The Dealer's office to be located within the State of California.
- If the office is located within a hotel, apartment building, rooming house, or single- or multi-family dwelling, the office must:
- Be used exclusively as the licensed business office.
- Be located on the ground floor.
- Have a direct exterior entrance.
The law also requires the established place of business to be open for inspection during normal business hours by representatives of HCD. Department representatives may inspect:
- The business premises.
- Required dealership records.
- Manufactured homes, mobilehomes, or commercial coaches located at the business.
If dealership records are maintained at a location other than the principal place of business, that location must also be available for inspection during normal business hours.
